Real Estate Taxation (Betterment and Acquisition) Bill (Amendment - Granting Real Estate Rights in Lieu of a House Destroyed or Desecrated in a Terrorist Event), 5786-2025

This bill seeks to amend the Real Estate Taxation Law. It stipulates that kibbutz members whose original homes were destroyed or desecrated during the events of October 7, 2023, and who received a right to alternative real estate from the kibbutz, shall be exempt from betterment tax and acquisition tax on the transfer of this right. The exemption shall also apply if the kibbutz itself or another person receives the right to the alternative real estate. The proposed change is intended to allow these kibbutz members, whose homes were destroyed or severely damaged, to receive rights to alternative real estate without a tax burden, in accordance with the decisions of the Israel Land Authority. The proposal refers to cases where the allocation of the alternative real estate is made after December 11, 2024.
