Citizenship and Entry into Israel Law (Temporary Order) (Amendment - Making the Temporary Order Permanent), 5785-2024

This bill seeks to make an existing temporary order a permanent law. The original temporary order, enacted in 2022, was intended to allow the government to restrict the granting of residency visas, residency permits, or Israeli citizenship to spouses of Israeli citizens if they are residents of Judea and Samaria, citizens or residents of a country specified in the law's addendum, or residents of the Gaza Strip. This is done while maintaining ministerial discretion in certain cases and considering vital state security interests. The current proposal seeks to delete the words "temporary order" from the original law, thereby making the restrictions established therein permanent provisions. Additionally, it seeks to repeal Section 18 of the Citizenship and Entry into Israel Law, which stipulates that the temporary order shall be extended from time to time by government decree, with Knesset approval, for a period not exceeding one year at a time. The proposal also refers to the Entry into Israel Law and the Administrative Affairs Courts Law, in which it seeks to delete the words "temporary order" from the relevant paragraphs. The explanatory notes to the bill state that Israel is at war and that the original order was intended to ensure the security of the state and its citizens. It is now argued that the time has come to enact the law permanently.
