Families of Fallen Soldiers (Rehabilitation and Pensions) Bill (Amendment - Prohibition of Dismissal of a Family Member During the First Year of Bereavement), 5784-2024

The bill stipulates that an employer may not dismiss an employee who is a family member of a soldier who fell in battle during the first year following the soldier's death. This prohibition also applies if the employee is the fiancé or fiancée of the soldier. The protection against dismissal shall not apply if a permit is granted by the Employment Committee, as is the case in certain instances involving discharged soldiers. The prohibition also applies to employees employed through a manpower contractor, provided they have worked for the actual employer for at least six months. In such a case, the actual employer shall not cause the dismissal of the employee in violation of the law's provisions. If it is proven that the actual employer caused the dismissal, they shall be considered the party dismissing the employee. An application for a dismissal permit shall be submitted by the actual employer or the manpower contractor. The bill defines "dismissal" as including the termination of a fixed-term employment contract if the contract was for a period of less than one year, or if it was renewed or extended for a period of less than one year, provided the renewal or extension occurred close to the start of the original contract. The provisions of the law shall also apply to temporary or casual workers, provided they have worked for the employer or at the workplace for at least six months. The bill clarifies that "dismissal" also includes a temporary cessation of work, as well as the non-renewal of a fixed-term employment contract. The bill follows instances where bereaved families were forced to deal with dismissal from their jobs in addition to their loss. The goal is to allow family members to cope with grief and loss without the added necessity of finding new employment.
