Aviation Services Bill (Compensation and Assistance for Flight Cancellation or Change of Conditions) (Amendment - Application of the Law to Premium Economy Class), 5784-2024

The proposed bill expands eligibility for compensation and assistance in the event of a flight cancellation or change of conditions to include passengers who purchased tickets in premium economy class. To date, the Aviation Services Law (Compensation and Assistance for Flight Cancellation or Change of Conditions), 5772-2012, did not include specific reference to premium economy class. As a result, passengers who purchased tickets in this class whose flights were cancelled or changed, primarily following the Swords of Iron War, received partial compensation or no compensation at all. The proposed amendment stipulates that passengers who purchased a ticket in premium economy class will be entitled to financial compensation, in accordance with the amounts specified in the second addendum to the law. In addition, it is proposed to amend the third addendum to the law so that these passengers will also be entitled to financial compensation in the event of a flight change or cancellation, as well as in the case of a tour package. The amendment also addresses cases of downgrading between classes: it adds the option for a transfer from premium economy class to business class, with a compensation amount of 50% of the difference. It adds the option for a transfer from premium economy class to business class, with a compensation amount of 70% of the difference. It adds the option for a transfer from premium economy class to first class, with a compensation amount of 80% of the difference. It adds the option for a transfer from business class to first class, or from premium economy class to first or business class. The amendment will apply to scheduled flights or charter flights in premium economy class.
