Employment of Employees by Manpower Contractors Bill (Amendment - Service Contractor in the Field of Nursing), 5784-2024

This bill is intended to amend the existing law regarding the employment of employees by manpower contractors and to apply specific changes to service contractors in the field of nursing. The primary change is defining a service contractor in the field of nursing as a manpower contractor, thereby applying the provisions of the existing law to them. This means that companies employing nursing staff and leasing them to households or institutions will need to comply with the conditions and restrictions applicable to manpower contractors. The proposal stipulates that a service contractor in the field of nursing may not employ a nursing worker for a period exceeding nine months, unless they meet certain conditions. These conditions include, among others, obtaining a special permit from the Ministry of Labor, or if the worker was employed by the contractor before the commencement of the law. Additionally, it is proposed to establish that a service contractor in the field of nursing may not employ a nursing worker if that worker was employed by another employer during the 12 months preceding their employment with the contractor. The proposal also addresses the situation where a service contractor in the field of nursing employs a nursing worker for a period exceeding nine months, and stipulates that in such a case, the worker shall be considered an employee of the service recipient (the actual employer), unless proven otherwise. The proposal seeks to apply these changes to service contractors in the field of nursing, while addressing exceptional cases and effective dates.
