Counter-Terrorism Bill (Amendment No. 9 and Temporary Provision) (Consumption of Terrorist Publications), 5784-2023 (Splitting of Cases Between the State Attorney's Office and Police Prosecution)

The law establishes a new offense of systematic and continuous consumption of terrorist publications, when it indicates identification with a terrorist organization. The penalty for this offense is one year of imprisonment. The offense applies to publications that include a direct call to commit a terrorist act, words of praise, sympathy or encouragement for a terrorist act, or documentation of the commission of a terrorist act. Random or good-faith consumption of publications for a legitimate purpose, such as providing information to the public, preventing terrorist offenses, or for research purposes, will not be considered an offense. The law is defined as a temporary provision for two years from the date of its publication. The Minister of Justice, with the consent of the Minister of Defense and the approval of the Constitution, Law and Justice Committee, may add terrorist organizations to the list defined in the Second Schedule of the law if the consumption of their publications poses a risk of committing a terrorist act. The initial list includes the ISIS organization and the Hamas organization. The Minister of Justice shall report to the Constitution, Law and Justice Committee twice a year on the implementation of the law's provisions, the number of investigations, detainees, indictments, and criminal outcomes, detailed by the terrorist organization whose publications were consumed. The law amends the Counter-Terrorism Law, 5776-2016, and changes the references to the schedules in the law.
