Maintenance of Cleanliness Law (Amendment No. 27 and Temporary Provision), 5786-2026

The law overhauls waste handling in Israel, with a focus on construction waste. It requires everyone who deals in waste, from collection, transport and storage to treatment, to register in a special register. Vehicles used to transport waste and storage containers must also be registered, and the vehicles must be fitted with tracking and control devices linked to an online monitoring system. Who is obligated and what changes: Waste carriers: must use registered vehicles and containers and install tracking and control devices on them. They must fill in a detailed waybill with details of the waste, its origin and destination, and send a copy to the site operator and the waste producer. They must keep a full record of the amounts of waste that entered and left the site, including details of the carrier, vehicle, driver and time of intake. Construction waste producers: anyone who produces construction waste (for example from building, renovation or demolition work) must prepare a waste handling plan before the work starts. The plan must include an estimate of waste amounts, identification of hazardous materials, planning for separation, recycling and reuse, and removal of the waste. Any change to the plan must be updated and documented. Construction waste producers must use only licensed carriers and licensed waste treatment sites, and pay for the services through a dedicated payment mechanism. Operators of construction waste treatment sites: must obtain an operating license. They must contract only with licensed carriers, accept waste only from them and pay them for the treatment. They must keep a detailed record of all waste entering and leaving the site, including details of the carrier, vehicle, container, waste amounts and intake and exit times. They must also transfer recycled construction waste products only to licensed sites. Owners of vehicles and containers: must register them in a dedicated register. Local authorities: must set up and operate sites for collecting small amounts of construction waste, or remove such waste directly from residents. They may also collect payments from operators of construction waste treatment sites. Restrictions and prohibitions: it is forbidden to carry out waste activities that require a license or registration without the proper license or registration. It is forbidden to transport waste in vehicles or containers that are not registered or not fitted with tracking and control devices. It is forbidden to dispose of construction waste other than through a licensed carrier and at a licensed site. It is forbidden to pay for construction waste treatment other than through the dedicated payment mechanism. Sanctions: the law sets new offenses and significant financial sanctions for violations. For example, failing to register, transporting waste in unregistered vehicles, or failing to meet the record-keeping and reporting requirements may lead to fines ranging from NIS 25,000 to NIS 500,000 (for corporations) and from NIS 25,000 to NIS 150,000 (for individuals), depending on the severity of the violation. In more serious offenses, such as significant pollution or a risk to the public, the fines can be higher and prison may also be imposed. Application: at first the law will apply to construction waste. Later its provisions may be extended to other types of waste through primary legislation. Temporary provision: the law contains several temporary provisions, for example on when certain sections take effect and on the powers of local inspectors.
